CraftyMariana Terms and Conditions (Digital Products + Membership)

1) Acceptance of these terms
By purchasing, accessing, or using any CraftyMariana products or services (including one-off templates and the Academy membership), you agree to these Terms and Conditions (“Terms”).
If you do not agree, do not purchase or use our products/services.
2) What these terms cover
These Terms apply to:

Digital Products: one-off purchases such as PDFs, Canva templates/links, downloads, guides, checklists, workshop plans, slide decks, and similar resources (whether delivered by email or accessed via a platform)

Memberships and subscriptions: access to the Crafts Workshop Academy (or any CraftyMariana membership, community, library, or portal)
-
Any included resources: templates, downloads, recordings, and materials provided inside the membership
3) Definitions

Digital Product means a downloadable file or access link (PDF and Canva templates/links included).

Membership means a recurring subscription that provides ongoing access to content/resources/community while your subscription is active.

Platform means any third-party service used to deliver content (for example, Kajabi, Canva, Stripe).
4) Accounts and access

You are responsible for keeping your login details secure.
-
You must not share your account or allow others to access purchased content through your account.
-
We may suspend or terminate access if we detect account sharing, fraud, or misuse.
5) Delivery for one-off Digital Products (email delivery)
-
One-off Digital Products are delivered by email to the address entered at checkout after successful payment.
-
Delivery is considered complete when the email containing the Digital Product or access link is sent.

If you do not receive your delivery email within a reasonable time, contact [email protected].
6) Membership access and what you receive
-
Membership gives you access to the membership content and benefits available at the time during your active subscription.
-
We may add, update, change, or remove content over time as part of maintaining and improving the membership.

If you cancel or your payment fails, your membership access ends at the end of your billing period (or immediately if access is revoked for breach or chargeback).
7) License and permitted use (important)
When you purchase a Digital Product or access materials inside the Membership, you receive a limited, non-exclusive, non-transferable, revocable license to use the materials for:
-
personal use, or
-
your own business use (internal use within your business)
You may customize templates for your own use.
8) What you cannot do (strict restrictions)
You must not, and must not allow others to:
-
share, resell, redistribute, gift, sublicense, or transfer any CraftyMariana materials (Digital Products or Membership content)
-
upload materials to shared drives, libraries, groups, memberships, or communities where others can access them
-
publish, post, or distribute materials online (including marketplaces or file-sharing sites)
-
claim the materials as your own original work
-
create competing templates or template packs for sale by recreating or lightly modifying our materials
-
remove copyright notices or “licensed to” markings (if included)
If you want a broader license (example: to use with clients, contractors, or students, or inside your own course), email [email protected] to request a written commercial license.
9) Canva-specific notes

Canva is a third-party platform. Your use of Canva is governed by Canva’s own terms.

Some templates may require Canva Pro features. You are responsible for confirming what you need.
-
We are not responsible for changes Canva makes to its platform, pricing, features, or availability.
10) Payments, subscriptions, renewals, and price changes
One-off purchases
-
You pay once. Delivery occurs after successful payment.
Membership subscriptions
-
Membership is billed on a recurring basis (monthly or according to the plan you choose at checkout).
-
By subscribing, you authorize recurring charges until you cancel.
-
We may change membership pricing in the future. If you are an active subscriber, we will provide notice where reasonably possible before changes take effect for your plan.
11) Cancellation

You can cancel your membership at any time according to the cancellation method provided at checkout or inside your account settings.
-
Cancellation stops future renewals. You retain access until the end of your current paid billing period unless access is terminated earlier due to breach, fraud, or chargeback.
12) Refund policy
Digital Products (one-off templates/downloads)

Because Digital Products are delivered electronically and cannot be returned, all sales are final and no refunds are provided once delivered.
Membership
-
Membership fees are for access during a billing period. We do not provide refunds for partial membership periods, including where you cancel mid-cycle, forget to cancel, or do not use the membership.

If you experience a technical issue preventing access, contact [email protected] and we will work with you to resolve it.
Consumer rights

This refund policy does not limit any rights you may have under applicable consumer protection laws that cannot be excluded (including rights under New Zealand law where applicable).
13) Chargebacks and payment disputes
By purchasing, you agree to contact us first at [email protected] to try to resolve any issue before initiating a chargeback or payment dispute.
If you initiate a chargeback after receiving a Digital Product or accessing Membership content, we reserve the right to:
-
revoke your license and require deletion of any copies of the materials
-
revoke access to the membership and any related products associated with the same customer record
-
block future purchases
-
provide evidence to the payment processor including order confirmations, delivery records, access logs, communication history, and a copy of these Terms accepted at checkout
If a chargeback is made in bad faith, we may pursue recovery of the disputed amount plus fees and reasonable costs, where permitted by law.
14) Community conduct (if your membership includes a community)
You agree to participate respectfully. We may remove content, suspend, or terminate access if you:
-
harass, abuse, or threaten others
-
post unlawful content
-
share private information without consent
-
spam, self-promote excessively, or disrupt the community
-
share or distribute paid materials
No refund is provided if access is terminated due to misconduct or breach.
15) Disclaimers
All materials are provided for general educational and informational purposes only and are not legal, financial, tax, medical, or professional advice. You are responsible for how you implement the materials.
16) Results not guaranteed
We do not guarantee any particular outcome, income, sales, bookings, or results.
17) Limitation of liability
To the maximum extent permitted by law:

we are not liable for indirect or consequential loss
-
our total liability for any claim relating to a purchase is limited to the amount you paid for that specific product or billing period
Nothing in these Terms excludes liability that cannot be excluded by law.
18) Intellectual property
All content and materials are owned by CraftyMariana. No ownership is transferred to you.
19) Termination and enforcement
We may suspend or terminate access immediately if you breach these Terms. We may take reasonable steps to protect our intellectual property, including takedown requests.
20) Changes to these terms
We may update these Terms from time to time. The version in effect at the time of purchase applies to that purchase.
21) Governing law
These Terms are governed by the laws of New Zealand, and you agree to the exclusive jurisdiction of the courts of New Zealand, except where consumer laws in your country require otherwise.
